UNC Pembrokes Title IX Office is committed to fostering a safe, inclusive and respectful environment for all members of our campus community. We work to prevent and address gender-based discrimination, harassment and sexual misconduct, ensuring compliance with federal and state regulations. Our office provides resources, support and guidance to those impacted, while promoting education and awareness to uphold the rights and well-being of every Brave.

Title IX of the Education Amendments of 1972

Title IX of the Education Amendments of 1972 (20 U.S.C. 禮1681 et seq.) is a federal civil rights law that prohibits discrimination based on sex in education programs and activities. This law applies to all public and private elementary and secondary schools, school districts, colleges and universities that receive federal funding. Discrimination under Title IX includes sexual harassment, sexual assault, dating and domestic violence, and stalking.

Title IX of the Education Amendments of 1972, as amended, prohibits discrimination on the basis of sex in any federally funded education program or activity. As such, Title IX mandates that no person shall be excluded from participation in or discriminated against on the basis of sex in programs or activities at educational institutions that receive federal financial assistance.
 
Sexual harassment is a form of sex discrimination prohibited under Title IX. Sexual harassment may be verbal, non-verbal or physical in nature, such as persistent unwanted sexual comments and/or advances or requests for sexual favors. Sexual harassment also includes acts of sexual violence.
 
Both victim and the harasser can be either male or female, and the victim and harasser can be the same sex. In the workplace, the harasser can be the victim's supervisor, a supervisor in another area, a co-worker, or someone who is not an employee of 51勛圖厙, such as a visitor or vendor. UNC Pembroke is committed to providing an inclusive and welcoming environment for all students, faculty and staff. 
 
All members of the university community are expected to engage in conduct that contributes to the culture of integrity and honor we strive to maintain. Acts of sexual misconduct, sexual harassment, dating violence, domestic violence and stalking jeopardize the health and welfare of our campus community.

Jeanne Clery Disclosure

The Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act  [20 U.S.C. & 1092(f)] requires institutions of higher education to produce and distribute an annual report containing information on their campus crime statistics and campus security policies.

Pregnant & Parenting Students

The US Department of Educations regulation implementing Title IX specifically prohibits discrimination against a student based on pregnancy, childbirth, false pregnancy, termination of pregnancy or recovery from any of these conditions. The Title IX regulation also prohibits a school from applying any rule related to a students parental, family or marital status that treats students differently based on their sex.

Sexual Misconduct

UNC Pembroke is committed to maintaining an educational environment free from sex-based discrimination. In support of this commitment, the university prohibits discrimination based on sex in all programs and activities. Title IX sexual harassment is specifically addressed under 51勛圖厙 Policy 4.25.05.

Every school must designate at least one employee responsible for coordinating the school's compliance with Title IX. The coordinators responsibilities include overseeing all complaints of sex discrimination and identifying and addressing any patterns or systemic problems that arise during the review of such complaints.

Title IX defines Sexual Harassment as conduct based on sex that satisfies one or more of the following:
  1. Quid pro quo an employee of the respondent conditioning the provision of an aid, benefit or service of the respondent on an individuals participation in sexual conduct;
  2. Unwelcome conduct determined by a reasonable person to be so severe, pervasive and objectively offensive that it effectively denies a person equal access to the recipients education program or activity; or
  3. Sexual assault as defined in , dating violence as defined in 34 U.S.C. 12291(a)(10), domestic violence as defined in , or stalking as defined in .
Any student, faculty, staff member, or visitor to the campus who has experienced, witnessed or has knowledge of gender-based harassment and/or discrimination, or other forms of sexual misconduct (dating violence, domestic violence, stalking or sexual assault) should report the incident immediately to the Office of Title IX and Clery Compliance (Title IX and Clery Compliance Director, any Clery Compliance Officer or the Campus Investigator) using the Sexual Harassment Reporting Form. Reports may also be made to a deputy Title IX coordinator, Police and Public Safety, the director of Student Conduct or the CARE Team. For crimes that are not sexual violence, use the Campus Incident Reporting Form.

Upon receiving a report, the Title IX and Clery Compliance Director will promptly provide the individual with a written explanation of their rights and available options. This includes information about supportive measures (such as academic accommodations, counseling services or changes to housing or class schedules) and a clear explanation of the universitys complaint resolution procedures. This ensures that individuals understand the available resources and the steps they may take moving forward.

The welfare of students is a priority at UNC Pembroke. The university encourages students, faculty and staff to assist others in need, which often includes reporting incidents of sexual misconduct to university officials.

We recognize that survivors and witnesses/bystanders may hesitate to report because they fear being disciplined for unrelated policy violations, such as underage drinking or drug use at the time of the incident. To remove this barrier and encourage support for those in need, the university offers limited immunity from certain policy violations connected to the reported incident.

Although policy violations cannot be entirely disregarded, UNC Pembroke prioritizes education over punishment in these cases, providing educational options rather than disciplinary action for those who come forward to assist others.

At UNC Pembroke, policies and regulations provide an independent framework to protect employees, visitors and students from sexual harassment in any educational program or activity.
